Booking Policy

1. General Photography Agreement

This Agreement is entered into between [Client ] and Carlos Vincent, doing business as “Carlos Vincent Imagery” and “www.carlosvincentimagery.com” (hereinafter referred to as “CVI”), located at 940 N Beltline Rd #111, Irving, TX 75061 (collectively referred to as the “Photographer,” “Party,” or “Parties”).

2. Services Provided

The Photographer agrees to provide professional photography services for the Client, according to the specifics discussed and agreed upon prior to the shoot date.

3. Recognition of Style

  1. Artistic Vision
    The Client acknowledges that the Photographer’s work is distinguished by a particular artistic style. This includes color and/or monochromatic imagery, use of natural and/or artificial light, a preference for candid moments, and a “natural appearance” editing technique.

  2. Creative Discretion
    While the Photographer welcomes Client preferences, the final decision regarding artistic elements—such as lighting, posing, location choice, and overall aesthetic—remains at the sole discretion of the Photographer.

  3. No Rejections or Revisions
    The Client waives any right to reject or request revisions to the photographs based on personal taste, style, or aesthetic preferences, provided the work is consistent with the Photographer’s established portfolio and prior representations.

4. Image Alteration

The Client agrees not to alter, edit, or crop any images provided by the Photographer without the Photographer’s express written consent. This policy preserves the integrity of the Photographer’s artistic vision.

5. Copyright Ownership

All images produced by the Photographer are protected by copyright. The Photographer retains full ownership of the copyright to all images, including the exclusive right to reproduce, distribute, and publicly display the photographs.

6. Restrictions on Usage

The Client may not sell, resell, or use the images for marketing or commercial purposes without the prior written consent of the Photographer. This ensures the Photographer maintains control over how and where the work is used.

7. Limited Usage License

  1. Non-Commercial, Personal Use
    The Client is granted a limited, non-exclusive license to use the images solely for non-commercial, personal portfolio purposes—including online or printed displays.

  2. Additional Permission Required
    Any use beyond the scope of this license, including commercial, marketing, or promotional activities, requires additional written permission from the Photographer and may be subject to additional fees. All other rights, including but not limited to copyright and distribution, are retained by the Photographer.

8. Payment Terms

The Client agrees to pay the Photographer a total fee for photography and content services.

Sessions are not confirmed until the Creative Fee is received. Late or missing payments may result in cancellation.

9. Termination

Either party may terminate this Agreement with written notice to the other party. In the event of termination, the Client agrees to pay for all services rendered and expenses incurred up to the date of termination.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

11. Entire Agreement

This Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter herein. Any amendments or modifications must be in writing and signed by both Parties.
